  • Judul artikel eJournal: Pelanggaran Hukum Humaniter Eritrea dalam Konflik Tigray Tahun 2020-2022
  • Pengarang (nama mhs): Muhammad Rahul Aminullah
  • Abstrak (max. 1600 huruf atau 250 kata): The Tigray Conflict is a conflict that occurred in the northern region of Ethiopia, stemming from dissatisfaction with Prime Minister Abiy Ahmed Ali’s decision to dissolve the EPRDF party coalition. The TPLF launched attacks on Ethiopian military bases. Following the outbreak of this conflict, one of Ethiopia’s neighboring countries became involved to assist Ethiopian forces. The study portrays the violations of humanitarian law committed by Eritrean Defense Forces (EDF) in the Tigray conflict. The violated articles include: Article 51 of Additional Protocol I to the 1977 Geneva Conventions, Article 76(1) of Additional Protocol I to the 1977 Geneva Conventions, Article 33(2) of the Fourth Geneva Convention of 1949, and Article 7 of the Rome Statute of 1998, as well as Article 8(2) of the Rome Statute of 1998. The violations take the form of crimes against humanity through actions involving the killing of civilians and conflict-related sexual violence (CRSV), and war crimes through actions involving the killing of civilians and looting. These actions contradict the jus in bello rules in international humanitarian law. The impact of sexual violence is crucial as it causes physical and psychological suffering to the victims, requiring substantial time and support for recovery.
