  • Abstrak (max. 1600 huruf atau 250 kata): The H-1B visa reform policy under President Barack Obama’s leadership in 2014 has increased the wave of braindrainer migration during the period 2014 to 2016, which gave rise to criticism from several parties and became a political economy discussion in the United States. Donald Trump ran as a Candidate for President of the United States in the 2016 election and promised a policy of reforming the H-1B visa with a selective mechanism that was more pro-American during his term of office. By using qualitative analysis techniques and collecting primary and secondary data based on archives, documents and the internet through mass media reporting, this research in the form of descriptive case study research explains the policies of President Donald Trump and his administration in reforming the H-1B visa immigration policy in the categories of merit and skillsbased worker migration (braindrainer). This research focuses on looking at Donald Trump’s H-1B reform policy during his term as President of the United States (2017- 2021) which is divided periodically.The result of the research showed that President Donald Trump’s policy in reforming the H-1B visa through the “Buy American Hire American” executive order tends to be restrictive by creating procedural policies and administrative memoranda policies which cause the denial rate for braindrainers’ acceptance and extension of work period petitions to increase significantly. Many of these rules and policies are not in accordance with legally applicable standard rules, so that many companies who feel disadvantaged by this policy file lawsuits against the government which results in the revocation of rules and policies that are not in accordance with the initial standards regulated in law.
